Preface to the 2024 Edition:

 

The future of Vietnam harbours a crucial need for constitutional changes in the context of the democratization process.

The 1992 Constitution of the Socialist Republic of Vietnam (SRV) and its reincarnation in the 2013 Constitution are both outdated. The Vietnamese nation needs a new constitution.

In order to contribute to this need, through the book “Draft Constitution for Vietnam on the bases of Constitutionalism, the Rule of Law and Pluralism” the author hopes to assist in the democratization process of Vietnam.

The origin, content, reason to give constitutional recognition to and relationship between concepts enshrined in this draft constitution have been explained by and large in the book On the Struggle for Democracy in Vietnam. However, they will be extrapolated relatively more concretely and in more detail here.

This book is divided into 2 parts:

Part One: Definition of the concept of Democracy based on Constitutionalism, the Rule of Law and Pluralism

Part Two: Text of Draft Constitution on the bases of Constitutionalism, the Rule of Law and Pluralism with commentary from the author

One of the not less important objectives of the author is to focus our intellectual energy on constitutional issues, within a concrete draft constitution, in lieu of arguing about a number of concepts and ideas which are totally theoretical in nature.

This 2024 Edition splits the 2017 Bi-lingual edition into 2 books. The English version and the Vietnamese version and shortens it by removing the part on the reform of the legal system.

This edition also includes a review of the book to update on recent political events and necessary adjustments because in the course of the last 7 years, the author has inevitably learned new things.
